For example, iFLY may collect Personal Information you provide (i) when you create an iFLY account to make bookings and reservations and (ii) during the iFLY waiver process in order to evaluate your eligibility to participate at an iFLY Tunnel.

In addition, iFLY may collect your photo and video information, provided you consent to collection of this Personal Information prior to flight. We may also collect Personal Information about you from our agents, vendors, consultants, and other service providers (collectively, Services Providers ) and from third parties. In some instances, you may be able to choose what information to provide, but sometimes we require certain information from you to use features of our Services.

 

Information That You Provide. We collect Personal Information about you directly when you:

 

  • purchase products from us;

  • enter search terms or other information through our Services;

  • subscribe to receive notifications from us;

  • exchange communications with us by mail, email, phone, or other means;

  • obtain customer service or technical support;

  • participate in promotional activities (coupons, special offers, sweepstakes, surveys, and contests, each a “ Promotion ,” including Promotions jointly sponsored or offered by third parties);

  • connect with us via social media;

  • otherwise voluntarily share information with us; and

  • create an iFLY account to make bookings and reservations.

 

Information Collected Automatically. iFLY and third parties may collect information from you automatically when you access the Services (“ Usage Information ”). Usage Information may include your IP address, device identifier, browser type, operating system, information about your use of the Services, and data regarding network connected hardware (such as computers or mobile devices), search engines used, the length of time spent on the Services, the pages you looked at on the Services, the address (or “ URL ”) of the websites you visited before and after visiting the Services, the frequency of your visits to the Services, and certain other available information. This may include the use of cookies and other technologies that help us understand your interactions with our Services, to serve you with ads on Third-Party Services that may be relevant to you, and to generally offer you a more personalized and relevant experience. The methods we use to collect Usage Information include:

 

  • Log Files. Log information is data about your use of the Services , such as IP address, browser type, Internet service provider, referring/exit pages, operating system, date/time stamps, and related data, which may be collected and stored in log files.

Our website also supports third-party cookies placed by our Services Providers, affiliates, and advertising partners.

It is temporarily downloaded onto your computer from iFLY’s web server, or from a third party on behalf of iFLY, and is active only while you are connected to the Services and deleted or deactivated thereafter.

  • Locationidentifying Technologies. Our tunnel finder feature may access and use information about your device location (such as IP address), or your account information, to suggest appropriate store locations. Content on our Services may be personalized based on various information we have about you to try to provide you with more location-relevant content.

  • Device and Activity Monitoring. Technologies that monitor, and may record, certain of your interactions with the Services, and/or collect and analyze information from your device, such as, without limitation, your operating system, plug-ins, system fonts, and other data, for purposes such as identification, security, fraud prevention, troubleshooting, tracking and/or improving the Services and customizing or optimizing your experience on the Services.

 

HOW WE SHARE PERSONAL INFORMATION

 

We may disclose your Personal Information for any purpose consistent with this Privacy Policy, our written statements at the point of collection, or applicable law. In general, we share Personal Information as follows:

  • with our Services Providers so they may provide their services to us. For example, we may share your Personal Information to provide customer service, operate, and improve our business and the Services, improve our products and customer service, help run our Promotions, process payments, perform auditing and quality control, communicate with you, and otherwise operate our business. i FLY, however, does not authorize its Services Providers to use your Personal Information they collect on our behalf, or provided by iFLY to the Services Providers to use on our behalf, to send you direct marketing messages other than related to iFLY, unless you otherwise consent;

  • to improve the Services or provide you with new products or services that may interest you;

  • with our advertising partners for ad targeting, remarketing, and providing customized advertising content;

  • as necessary, for the following purposes: (a) to comply with any legal process; (b) to respond to requests from public or government authorities; (c) to enforce our terms and conditions; (d) to protect our operations and protect our rights, privacy, safety, or property, and/or that of you or others; and (e) to allow us to pursue available remedies or limit potential damages to us.

  • with our insurers and professional advisers for managing risks, obtaining professional advice, exercising or defending against legal claims; and

UGC. If you choose to submit user-generated content (“ UGC ”) to any public area of the Services, your UGC will be considered “public” and will be accessible by anyone, including iFLY. Notwithstanding anything to the contrary, unless otherwise explicitly agreed by us, Personal Information included in UGC is not subject to iFLY’s usage or sharing limitations, or other obligations regarding Personal Information collected under this Privacy Policy or otherwise and may be used and shared by iFLY and third parties to the fullest extent not prohibited by applicable law. iFLY encourages you to exercise caution when making decisions about what you disclose in such public areas.

 

Third-Party Services . The Services may include hyperlinks to, or connection with, the Services (such as applications and plug-ins) and services operated by third parties (“ Third-Party Service(s) ”). These Third-Party Services may use their own cookies, web beacons, or other Tracking Technologies to independently collect information about you and may solicit Personal Information from you.

 

ANALYTICS

 

Our website uses analytics technology provided by our Services Providers (including, without limitation, Google Analytics, Meta Custom Audience, Google Ad Services and) to understand how users interact with the site, improve our web experience, and better market our products. Both iFLY and Third-Party Services may have access to certain information about you and your use of the Services and any Third-Party Service. iFLY may engage and work with Services Providers and other third parties to serve advertisements on the Services and/or on Third-Party Services. Some of these ads may be tailored to your interests based on your browsing of the Services and elsewhere on the Internet, which may include use of Cross-device Data, sometimes referred to as “interest-based advertising” (also referred to as “online behavioral advertising”), which may include sending you an ad on a Third-Party Service after you have left the Services (also referred to as “retargeting”).

iFLY is not responsible for the effectiveness of any third parties’ opt-out options or the accuracy of their statements regarding their programs.

 

Email Communications

 

You can opt out of receiving certain promotional communications (such as emails) from iFLY at any time. For promotional e-mails, you may click on the unsubscribe link, or if available, change your communication preferences from within your iFLY account. If you opt-out of our marketing email communications, we may, subject to applicable law, still send you non-promotional communications, such as those related to your iFLY account or purchases. Unsubscribing from our marketing communications will not affect the level or quality of service we provide to you.

 

DATA SECURITY AND MONITORING

 

We use technical and administrative security measures to reduce the risk of loss, misuse, unauthorized access, disclosure, alteration of, or to otherwise protect, your information. Although we implement reasonable security measures on our Services, we cannot guarantee the security of information you submit via the Internet. It is your responsibility to make sure that your passwords and account registration information are secure and not shared with third parties.

 

AGE RESTRICTIONS

 

The Services are intended for a general audience and not directed to children less than 13 years of age. iFLY does not intend to collect personal information as defined by the U.S. Children’s Privacy Protection Act (“ COPPA ”) (“ Children’s Personal Information”) in a manner that is not permitted by COPPA. If we obtain knowledge that we have collected Children’s Personal Information in a manner not permitted by COPPA, we will remove such information to the extent required by COPPA.

Any California residents under the age of eighteen (18) who have registered to use the Services or who posted content or information on the Services can request removal by contacting iFLY and (i) specifying where the content or information was posted and (ii) attesting that such was posted by a minor. iFLY will then make reasonably good faith efforts to remove the post from prospective public view or anonymize it so the minor cannot be individually identified to the extent required by applicable law. This removal process cannot ensure complete or comprehensive removal. For instance, third parties may have republished or archived content by search engines that iFLY does not control.

 

NEVADA PRIVACY NOTICE

 

Nevada law allows residents to opt out of the sale of certain Personal Information, called “covered information.” We do not sell covered information as defined under Nevada law and we have no plans to change that practice. This section applies to Virginia Consumers (as defined by the Virginia Consumer Data Protection Act (“ VCDPA ”)) that use our Services. Capitalized terms defined in the VCDPA that are used in this section shall have the same meaning as in the VCDPA.

This section describes our collection, use, and disclosure of Personal Data. You can learn more about the Personal Data we process and the purpose for processing such Personal Information in the “ Personal Information We Collect and Why We Collect It ” section above.   5. Right to Opt-Out of Targeted Advertising . You may request that we stop disclosures of your Personal Data for Targeted Advertising via cookies and tracking technologies by clicking the “Do Not Sell or Share My Personal Information” link in the footer at the bottom of our website.

  6. Right to Opt-Out of Profiling . You have the right to opt-out of our processing of Personal Information for the purposes of profiling. Our profiling does not result in decisions that produce legal or similarly significant effects and, therefore, we do not provide this right.

Virginia Consumers may submit their VCDPA requests here . Please note that, depending on the nature of your request, you may be asked to provide information to verify your identity in order for us to process your request. We will confirm receipt of your request and respond to your request as soon as we reasonably can and no later than legally required.

iFLY is based in the U.S. and the information iFLY and its Services Providers collect is governed by U.S. law. If you are accessing the Services from outside of the U.S., please be aware that information collected through the Services may be transferred to, processed, stored, and used in the U.S. Data protection laws in the U.S. may be different from those of your country of residence.
